Terms and Conditions for BLMT Group Pty Ltd T/A M Home Styling (ABN: 28 685 940 783)

1. AUTHORITY AND PREPARATION FOR INSTALLATION

1.1 Client Authorization: “The Client” grants M Home Styling, its employees, and contractors permission to enter and remain on the property (“the Property”) at reasonable times for the purpose of furnishing and styling as outlined in this agreement. This includes the installation and removal of furniture and accessories, as well as access for styling reviews.

1.2 Quote Acceptance: To book or schedule an installation date, "The Client" must confirm the provided quote by signing the quotation acceptance. Once M Home Styling receives approval, furniture allocation and preparation for installation will commence. Changes made after approval may be negotiated between the parties.

1.3 Quote Validity: Quotes are valid for 30 days from the issue date. If an installation date is being held, acceptance must be received within 7 days of the installation date. M Home Styling will notify “The Client” if the held date is at risk (see Section 7 for cancellations or date changes).

1.4 Property Preparation: “The Client” is responsible for ensuring “the Property” is ready for installation on the agreed date. This includes ensuring the property is vacant, all renovations are completed (except exterior work), the interior is clean, and driveways/paths are clear for safe access.

2. PAYMENTS

2.1 Payment Terms: Payments are to be made in full three (3) days prior to installation, with confirmation emailed to M Home Styling. Late payments require immediate full payment to avoid installation delays.

2.2 Payment Methods: Payments can be made via cash, cheque, or electronic funds transfer (EFT).

2.3 Cheque Payment Option: The installation will be scheduled only once the cheque has cleared and the funds are secured into the bank account.

3. FURNITURE AND ACCESSORIES

3.1 Ownership: All furniture and accessories installed in “the Property” remain the property of M Home Styling.

3.2 Usage Restrictions: The furniture and accessories are for display purposes only and must not be used for daily activities, moved, or removed from the property. No construction or renovation work may occur once the items are installed.

3.3 Liability: M Home Styling is not responsible for any injury, death, damage or loss suffered by the client, by any agent of the client or by any person or prospective buyer invited upon the premises by the client or the client’s agent whilst the display stock is staged on the premises. M Home Styling accepts no liability if the property does not sell before the rental period for the display items ends, or if it sells for less than expected.

3.4 Damages: If any of the stock is damaged whilst in the client’s possession, the client must pay M Home Styling a sum equal to the reasonable market cost of repairing or replacing the damaged items of stock.

4. DAMAGE TO FURNITURE AND ACCESSORIES

M Home Styling maintains general insurance for all items during the rental period. “The Client” will be liable for any damage caused by improper use and agrees to cover the costs of replacement or repair.

5. DAMAGE TO PROPERTY

5.1 Liability for Damage: M Home Styling will address any damage caused by its employees or contractors under its Public Liability insurance.

5.2 General Wear and Tear: M Home Styling is not liable for scuffs or minor damage incurred during open homes or inspections.

5.3 Artwork Installation: Artwork will be securely hung using appropriate hooks. M Home Styling will not be liable for any damage caused to the premises by nails/wall hooks inserted into the wall for the purpose of hanging artwork/s or wall hangings, and M Home Styling is not responsible for the removal of such nails/wall hooks or for the repair of any holes in the walls caused by use of the nails/hooks.

6. TERM AND EXTENSION

6.1 Extensions: The initial term can be extended by mutual agreement, subject to the same terms and conditions.

6.2 Early Sale: No refunds will be issued if the property sells before the agreement ends. M Home Styling reserves the right to remove items at its earliest convenience.

7. CANCELLATIONS/CHANGE OF INSTALLATION DATE

Cancellations require at least three full business days’ notice. Changes to the installation date will be accommodated based on availability.

8. INTELLECTUAL PROPERTY

M Home Styling reserves the right to photograph the Project and use these photographs to promote its professional services through various media, including publications, advertising, public relations materials, brochures, websites, or other marketing channels. "The Client" agrees to provide M Home Styling with reasonable access to photograph or otherwise record the Project before and/or after completion.
